General Terms and Conditions of Eventticket4you for the procurement of tickets

Eventticket4you Stiftstrasse15, 30159 Hannover (hereinafter referred to as “Eventticket4you”) brokers tickets (hereinafter referred to as “tickets”) to end customers in the name of and for the account of event organizers.

Eventticket4you is neither organizer of the offered events, nor does Eventticket4you have any influence on their realization. Accordingly, through the purchase of tickets, contractual relationships concerning the event and its attendance come into being exclusively between the ticket holder (hereinafter referred to as “customer”) and the respective event organizer.

1. scope of application

These General Terms and Conditions (hereinafter referred to as “GTC”) shall apply to the brokerage of

tickets (hereinafter referred to as “purchase or sale of tickets”). All tickets are always mediated by Eventticket4you in the name and on account of the respective organizer.

2 Contract between customer and organizer

2.1 By purchasing a ticket, a contract is concluded exclusively between the customer and the respective event organizer concerning the event visit. The name and address of the event organizer will be stated in the order process. There is no contract between Eventticket4you and the customer regarding the event visit. Eventticket4you only mediate tickets in the name and on account of the respective event organizer to the customer, including the handling of the ticket purchase (ticket shipment, payment).

2.2 When visiting the event, separate terms and conditions of the respective organizer regularly apply.

3 Conclusion of Contract

3.1 A purchase of tickets is concluded by an e-mail from Eventticket4you confirming a previous online order. The offer to conclude a contract is made by the customer as soon as he has placed his ticket order online (by clicking on the “Buy now” button). With the sale or shipment of the ticket, a contract for the event visit is concluded with the respective organizer through the mediation of Eventticket4you.

3.2 In the online booking process, the customer confirms the final ticket prices and shipping or handling fees listed there. These prices and fees are shown as part of the compilation of all desired tickets referred to as the “shopping cart”. All price quotations in the online ordering process are inclusive of statutory value-added tax. The fees thus displayed before the conclusion of the contract are part of the contract between the customer and the organizer. Eventticket4you saves the order data and sends the same as well as this GTC (as a link) to the customer by e-mail.

4. checking the tickets

The customer is obliged to check the tickets immediately after receipt for completeness and correctness of the information on the ticket (name, date, time of the event, ticket price, etc.). Complaints are to be declared to Eventticket4you immediately in text form (e-mail, letter, fax).

5. special conditions for the use of the print@home system

In the so-called print@home system, the customer prints out his ticket purchased online immediately after the conclusion of the purchase contract or after receipt of payment and subsequent activation of the corresponding ticket via his Internet access on his PC. The uniqueness of the ticket is given by an imprinted barcode, which is identified upon entry to the event with a

Status: 11.06.2022 barcode scanner. This makes it impossible to visit an event more than once by duplicating tickets. The value of a print@home ticket is therefore not the uniqueness of the ticket (normally white paper), but the uniqueness of the barcode information. The customer is obliged to keep the ticket protected from duplication by third parties. In case of loss and/or misuse of the ticket, the customer has no right to attend the event or to receive a refund of the ticket fee. The resale to third parties of tickets purchased under the print@home procedure is prohibited. In the event of infringement, the ticket purchaser or the ticket holder shall lose the right to attend the event without entitlement to reimbursement of the ticket price or the aforementioned ticket fees. Anyone who duplicates and/or circulates tickets without permission may be held liable by the organizer for any consequential damages. In addition, criminal prosecution will follow in any case (misappropriation of services, fraud, forgery of documents).

6. no commercial resale of tickets

Tickets are only sold to end customers. Commercial resale is generally prohibited unless otherwise agreed upon at the time of purchase. The resale of tickets requires the express prior consent of Eventticket4you in text form.

7. non-existence or existence of a right of revocation and sample revocation form 7.1 Exclusion (non-existence) of the right of revocation for ticket purchases

According to § 312g para. 2 no. 9 BGB (German Civil Code), a right of revocation is excluded in the case of distance contracts for services related to leisure activities that provide for a specific date or period for the provision of the service. Therefore, the customer has no right of withdrawal for the order of services offered by Eventticket4you in the name and for the account of the respective organizer in connection with leisure activities, in particular orders of tickets for events. Each order of tickets is thus binding immediately after confirmation by Eventticket4you on behalf of the organizer and obligates the customer to accept and immediately pay for the tickets ordered. Eventticket4you has the right to return tickets not paid by the day before the event to the pre-sale. In this case, the customer is still entitled to payment of the contractually owed advance sale, system, processing, and shipping fees. Further claims for damages of the respective organizer from its contractual relationship with the customer remain valid, if applicable.

7.1 Right of revocation

For all other orders, the customer is entitled to the right of withdrawal described below.

You have the right to cancel this contract within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.

In order to exercise your right of withdrawal, you must inform us, Eventticket4you, Stiftstrasse 15,30159 Hannover, e-mail: info@oneworldmusic.net by means of a clear declaration (e.g. a letter sent by post, or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form, which is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (except for additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that are not necessary for testing the condition, properties, and functioning of the goods.

8. warranty claims of the customer (cancellation, rescheduling, etc. of an event)

8.1 Warranty claims of the customer in connection with an event or a service arranged by Eventticket4you in the name and for the account of the respective organizer exist only against this organizer. Eventticket4you are not liable for the execution of the event or the refund of paid ticket prices in case of canceled, or postponed events. Furthermore, Eventticket4you shall not be liable for any damages resulting therefrom.

8.2 In case of postponement or cancellation of an event, all claims are to be asserted by the customer directly against the respective event organizer. There is no right for Eventticket4you to take back the tickets.  Eventticket4you will, however, endeavor to settle the matter in the interest of the customer.

A retraction of tickets requires that the organizer instructs Eventticket4you with the retraction and Eventticket4you receives the money to be refunded from the organizer before the refund. The reverse transaction will be carried out by Eventticket4you on behalf and for the account of the respective organizer. If Eventticket4you takes back tickets on behalf of an organizer, this only applies to tickets that were also arranged by Eventticket4you. Redemption of tickets purchased at other places is not possible.

9. insolvency of the organizer

In case of insolvency of the organizer, there is no claim against Eventticket4you for compensation of a claim of the customer against the organizer. In case of insolvency, the customer has to assert his claims directly against the organizer or the responsible insolvency administrator.

10. no exchange of tickets

The exchange of tickets is excluded.

11. payment

11.1 Eventticket4you is commissioned by the respective organizers to handle the payment processes in the context of online ticket sales. For this purpose, these organizers have authorized Eventticket4you in advance to assert all ongoing claims arising from online sales in the name and for the account of the respective organizer against the customer and to enforce them both out of court and in court. The aforementioned claims of the organizer include all so-called system fees, advance booking fees, processing and shipping fees, which are agreed upon in the ticket purchase transaction between the organizer and the customer.

11.2 Eventticket4you carries out the collection of credit card payments and direct debit orders of the customers in the name and on account of the respective organizer. The credit card charge takes place at the moment of the ticket purchase. In the case of direct debit, the bank collection takes place on the day the ticket ordered by the customer is sent.

11.3 In case of delivery of tickets to non-EU countries, no customs duties, taxes or fees will be charged.

12 Place of performance, place of jurisdiction

The sole place of performance for delivery, service, and payment is Freiburg if the customer is an entrepreneur in the sense of § 14 BGB (German Civil Code). If the customer is a merchant, Freiburg shall be the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. This also applies to non-merchants in the case of cross-border contracts.

13. no willingness to participate in dispute resolution proceedings

Eventticket4you are not willing and obliged to participate in dispute resolution proceedings before a consumer arbitration board. The platform of the EU Commission for online dispute resolution can be reached at: www.ec.europa.eu/consumers/odr.

14 Applicable law

The law of the Federal Republic of Germany shall apply exclusively. The provisions of the UN Sales Convention shall not apply.
